O.C.G.A. §34-9-2.
Georgia requires workers compensation once you regularly employ three or more people, full time or part time — O.C.G.A. §34-9-2. Regular part-timers count, and so do corporate officers and LLC members who have rejected coverage. If you work as a subcontractor without coverage, the general contractor above you can be held liable for your injured workers under O.C.G.A. §34-9-8, which is why GCs ask for a certificate before you start. If your renewal is more than 60 days out, get an indication now and hold it against the renewal offer when it lands. Within 60 days of your renewal or effective date, we can work a real quote.

3 employees, part time or full time. That is the Georgia threshold.
Georgia State Board of Workers' Compensation
Employers with three or more employees are required by law to provide coverage.
What Georgia requires
Employers who regularly employ three or more people, full time or part time, must carry workers compensation. O.C.G.A. §34-9-2. Regular part-time and seasonal workers count toward the three. Corporate officers and LLC members who reject coverage still count toward the headcount.
What we need from you
Complete in just a minute with a few quick questions. No ACORD form. No insurance vocabulary. Mod at 1.30 or under and premium under $50,000: we do not ask for loss runs.
What you get
An indication in one to two business days, reviewed and signed by a licensed principal of this agency. Hold it against the renewal. Within 60 days of your renewal or effective date, we can work a real quote. Direct-billed on Clear Spring Property and Casualty Group paper. An indication is not a quote, not a binder, and it creates no coverage.
The panel of physicians
Georgia employers must post a panel of physicians, the injured worker’s bill of rights, and a notice naming their insurer where employees can see them. The panel is how your crew picks a doctor after an injury, and a missing or out-of-date panel can cost you control of the claim. When we bind, we send you the posting your carrier provides so it is on the wall before the first job.
If you have fewer than three
Under three regular employees, Georgia does not require coverage — but a general contractor can still require it, and a subcontractor’s uninsured worker can become the GC’s claim under O.C.G.A. §34-9-8. If you have W-2 payroll and you work for GCs, you will likely be asked for a certificate either way.
