Every Florida employer must secure the payment of workers compensation — Fla. Stat. §440.38. Construction employers, including plumbing, HVAC, electrical, and fire sprinkler contractors, are in at one employee, full time or part time. There is no four-employee threshold on a Florida jobsite. Coverage has to be a Florida policy or a Florida endorsement using Florida class codes and rules. Every employer shall secure the payment of compensation under this chapter: (a) By insuring and keeping insured the payment of such compensation with any stock company or mutual company or association or exchange, authorized to do business in the state. Any employer who meets the requirements of subsection (1) through a policy of insurance issued outside of this state must at all times, with respect to all employees working in this state, maintain the required coverage under a Florida endorsement using Florida rates and rules pursuant to payroll reporting that accurately reflects the work performed in this state by such employees.

What Florida requires

Construction employers with one or more employees must secure workers compensation. Fla. Stat. §440.38. Plumbing, HVAC, electrical, and fire sprinkler work is construction. An out-of-state policy is not enough unless Florida is endorsed with Florida class codes and rules. Non-construction shops are a different fact pattern; this page is written for contractors.

The contractor licence and the certificate

If you hold a Florida contractor licence and you have employees, you need workers compensation in force. We issue certificates as part of binding. A construction exemption for a corporate officer is not a policy covering payroll, and a general contractor will not accept an exemption in place of coverage on employees. Confirm an exemption in writing before you skip coverage. If you have W-2 employees, you are not exempt for those people.
